Ruiqi riskerar utvisning – hjälp oss stoppa det! / Ruiqi faces expulsion – help us stop it!
År 2019 gifte sig Ruiqis mamma med Årefödde Dag i Kina, efter flera års relation. Efter pandemin beslutade sig familjen för att flytta till Sverige. Ruiqi och hennes mamma arbetade målmedvetet för att lära sig svenska och etablera sig så snabbt som möjligt — och lyckades fullt ut. År 2024 fick mamman lärarlegitimation och anställning som lärare, samtidigt som dottern påbörjade naturvetenskapsprogrammet på gymnasiet, med planerad studentexamen i juni 2026 och mycket goda framtidsutsikter.
År 2025 förändrades dock situationen dramatiskt. När Ruiqi fyllde arton år i april hade Migrationsverket ännu inte fattat beslut i hennes ärende om uppehållstillstånd. När beslutet väl kom — efter en administrativ försening som i sig strider mot gällande regler — fick hon avslag. Enligt utlänningslagen betraktas en person som fyllt arton år som vuxen och därmed som självständig, oavsett faktisk beroendeställning gentemot sin familj i Sverige och utan reell anknytning till ursprungslandet.
Beslutet har överklagats, men utgången är osäker. Vid ett negativt besked har familjen valt att inte splittras, utan att lämna landet tillsammans. Ett sådant scenario skulle vara en förlust för samhället, för det är orimligt att ett land i ett demografiskt pressat läge saknar rättsliga verktyg för att låta dem stanna. Men den största förlusten drabbar den lokala gemenskapen: vänner, kollegor, klasskamrater och föreningsliv. Känslan av orättvisa är påtaglig, och tystnaden kring detta måste brytas.
Vi kräver därför:
— att Migrationsverket omprövar sitt beslut och i högre grad beaktar att Ruiqi lämnade Kina för fem år sedan utan realistiska möjligheter att återvända till det kinesiska skolsystemet, vilket riskerar att strida mot Sveriges åtaganden enligt barnkonventionen, samt att hon är fullt integrerad i det svenska samhället;
— att Östersunds kommun tar ställning i ärendet och visar att kommunen står upp för sina invånare, tydliggör de lokala konsekvenserna av den nuvarande återvändarpolitiken och uppmanar regeringen att anpassa lagstiftningen.

In 2019, Ruiqi’s mother married Dag (born in Åre) in China, following a relationship of several years. After the pandemic, the family decided to move to Sweden. Ruiqi and her mother worked purposefully to learn Swedish and establish themselves as quickly as possible — and succeeded fully. In 2024, the mother obtained her teaching qualification and a position as a teacher, while her daughter began the natural sciences program at upper secondary school, with graduation planned for June 2026 and very strong future prospects.
In 2025, however, the situation changed dramatically. When Ruiqi turned eighteen in April, the Swedish Migration Agency had still not made a decision in her residence permit case. When the decision finally came — after an administrative delay that in itself violates applicable regulations — her application was denied. Under the Foreigners Act, a person who has turned eighteen is considered an adult and thus independent, regardless of their actual dependence on their family in Sweden and without real ties to their country of origin.
The decision has been appealed, but the outcome is uncertain. In the event of a negative ruling, the family has chosen not to be split up but to leave the country together. Such a scenario would be a loss for society, as it is unreasonable that a country under demographic pressure lacks legal tools to allow them to stay. But the greatest loss would be borne by the local community: friends, colleagues, classmates, and civil society organizations. The sense of injustice is palpable, and the silence surrounding this must be broken.
We therefore demand:
— that the Swedish Migration Agency reconsider its decision and give greater weight to the fact that Ruiqi left China five years ago, without realistic opportunities to return to the Chinese school system, which risks contravening Sweden’s obligations under the Convention on the Rights of the Child, and that she is fully integrated into Swedish society;
— that the Municipality of Östersund take a position in the case and show that the municipality stands up for its residents, clarify the local consequences of the current return policy, and urge the government to adapt the legislation.
